We share the Letter to the Editor of our partner Gabriel Palma entitled “Rural subdivisions: What if the law prevailed?”, which was published in the DF, a Chilean daily.
In view of the situation of different administrative authorities that have sought to halt the processing of applications for subdivision of rural properties and with contradictory criteria, an expected process of court proceedings has begun. Just recently a civil court decided to suspend an official order from the Ministry of Agriculture and a circular from the Agriculture and Livestock Service (SAG) that opposed rural subdivision.
Gabriel Palma says: “It is essential to unify criteria to provide legal certainty to both the community and investors, and thus obtain clarity on the regulatory framework within which real estate, housing or agricultural projects can be developed. This determination should not be left to the discretion of the current authority, a position that our courts are apparently beginning to support”.
