Following a query from a taxpayer, the Chilean Internal Revenue Service has raised the alarm in the corporate world due to Issue No. 32, which states that it may apply its power to tax a certain type of corporate restructuring aimed at incorporating family members’ offspring into a holding company, even if it is not potentially elusive.
Maria Soledad Diharasarri Lecanda, partner in charge of the tax practice, was interviewed about this in a note published by Diario Financiero, and stresses that although the challenged structures must be examined on a case-by-case basis, the vast majority of similar restructurings obey to a legitimate business reason.
